Terms and Conditions

1. Introduction and Acceptance

By accessing and using the VanessaHajje.art website (the “Site”) and/or placing an order for artwork, prints, or related services (collectively, the “Services”), you (the “Client” or “Customer”) agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and Vanessa Hajje (“Artist,” “we,” or “us”). If you do not agree with these Terms, please refrain from using the Site or Services.

2. Scope of Services

2.1 Products and Artwork.

The Artist offers original artwork, reproductions, prints, and other art-related products via the Site. The descriptions, images, and other content displayed on the Site are provided for informational purposes only. We reserve the right to update, modify, or discontinue any product or service at any time without prior notice.

2.2 Custom Commissions.

In the event that custom work is commissioned, a separate agreement may be required outlining specific details, timelines, and pricing. Custom commissions shall be governed by these Terms, unless otherwise expressly provided in a separate written agreement.

3. Orders, Payment, and Fulfillment

3.1 Placing an Order.

When you place an order through the Site, you agree to provide accurate and complete information. Orders are subject to acceptance by the Artist, and we reserve the right to cancel any order for any reason, including but not limited to pricing errors or inventory issues.

3.2 Payment.

All prices displayed on the Site are in the currency indicated and are subject to applicable taxes. Payment must be made through the payment methods provided on the Site. The Artist uses reputable third-party payment processors; however, the Artist is not responsible for any issues arising from payment processing outside of our direct control.

3.3 Shipping and Delivery.

The Artist will endeavor to ship orders within the stated time frames; however, delivery dates are estimates and not guaranteed. Risk of loss and title for products purchased pass to the Client upon delivery to the carrier. International orders may be subject to customs fees and additional charges, which are the responsibility of the Client.

3.4 Returns and Refunds.

Due to the nature of artwork and print-on-demand products, all sales are final unless otherwise specified. In the event of a defective or mis-shipped product, please contact us within [insert a specific number of days, e.g., 7 days] of receipt, and we will work to resolve the issue. Custom commissions are non-refundable once work has commenced, except in cases where the Artist fails to deliver as agreed.

4. Intellectual Property

4.1 Ownership.

All content on the Site, including but not limited to artwork, images, graphics, text, and design elements, is the intellectual property of Vanessa Hajje or its licensors. No part of the Site or any materials contained on it may be reproduced, modified, distributed, or republished without the prior written consent of the Artist, except for personal, non-commercial use.

4.2 Usage Rights.

Purchasing a product from the Site does not grant the Client any rights to the underlying artwork beyond personal, non-commercial use. Any commercial use or reproduction of the artwork requires express written permission from the Artist.

5. Limitation of Liability and Disclaimers

5.1 Disclaimer of Warranties.

The Site and Services are provided “as is” and “as available” without any warranties of any kind, either express or implied. The Artist disclaims any warranties regarding the reliability, accuracy, or completeness of the content, products, or Services provided.

5.2 Limitation of Liability.

In no event shall the Artist be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or the Services, even if advised of the possibility of such damages. The Artist’s aggregate liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by the Client for the product or service in question.

6. Indemnification

You agree to indemnify, defend, and hold harmless Vanessa Hajje, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site or Services, or your violation of these Terms.

7. Governing Law and Dispute Resolution

7.1 Governing Law.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Artist primarily operates, without regard to its conflict of law principles.

7.2 Dispute Resolution.

Any disputes arising out of or relating to these Terms or your use of the Site or Services shall be resolved first through good-faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to mediation or arbitration in the jurisdiction where the Artist is located. By using the Site or Services, you agree to submit to the personal jurisdiction of such courts.

8. Modifications

The Artist reserves the right to modify or update these Terms at any time, with or without notice. Changes will be effective immediately upon posting on the Site. Your continued use of the Site or Services after any modifications constitutes your acceptance of the revised Terms.

9. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
